By using our website and purchasing our products, you agree to these Terms and Conditions, our Privacy Policy, and any other applicable policies. If you do not agree with these terms, please do not use our website.

Products and Orders

All product listings on our website are subject to availability. We reserve the right to modify or discontinue products without notice. Orders are considered offers to purchase our products. We reserve the right to accept or decline orders at our discretion.

Pricing and Payment

All prices listed on our website are in US dollars. Prices are subject to change without notice. We accept various payment methods. Payment is required before order processing. You agree to provide accurate and complete payment and contact information.

Shipping and Delivery

We offer shipping to locations within the US. Delivery times are estimates and may vary based on factors beyond our control. You are responsible for providing accurate shipping information. We are not liable for delays or errors due to incorrect information.

Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes shall be resolved through binding arbitration in Orange County, California.

Terms of Sale

Please read these Terms of Sale carefully as they form the basis of your contract with Moto E Bikes. This agreement is made at the time of your ordering any products or services offered and purchased through the Moto E Bikes Website (“Products”). By purchasing Products from Moto E Bikes, you signify you have read and accepted these Terms of Sale.

(a) Ordering and Product/Services Policies

  • You must be 18 years of age or over and possess the legal capacity and authority to purchase Products from Moto E Bikes. Use of Moto E Bikes Products for illegal or unauthorized purposes is prohibited.

  • Moto E Bikes reserves the right to refuse service to anyone for any reason at any time.

  • Moto E Bikes may limit or cancel quantities purchased per person, per household, or per order. Orders placed under the same customer account, credit card, or billing/shipping address may be subject to such restrictions.

  • Certain Products may be available exclusively online through the Moto E Bikes Website and are subject to return or exchange according to Moto E Bikes’ Shipping/Refund Policy.

  • Moto E Bikes has made every effort to display accurately the colors and images of our Products on the Moto E Bikes Website; however, the final purchased Product may differ.

  • Moto E Bikes may limit sales of Products based on geographic region or jurisdiction.

  • Descriptions of Product pricing are subject to change without notice.

  • Moto E Bikes reserves the right to discontinue offering or selling any Product at any time.

  • Moto E Bikes may update components, materials, or parts of the e-bikes without notice.

(b) Payment and Credit Card Services

  • You agree to provide accurate purchase and account information to Moto E Bikes for transactions.

  • You understand that Submissions may be transferred unencrypted and that credit card information is encrypted during transfer.

(c) Shipping and Returns Policy

  • It is your responsibility to verify shipping address and delivery date. Moto E Bikes is not responsible for lost or missing packages.

  • A 30-day return policy applies to electric bikes (see model exclusions). Restocking fees apply to canceled or returned orders that were not assembled or tested.

  • To qualify for a return, the bike must meet specified conditions. Buyer is responsible for return shipping.

  • Returns are not available for batteries or accessories.

(d) Pre-Order and Cancellation Policy

  • Pre-orders are charged at the time of ordering. Estimated shipping dates may change.

  • Cancellations before shipment are subject to a 3% payment processing charge. Cancellations after shipment incur a $250 fee.

  • Verify shipping address and delivery date. Failed deliveries may result in a $250 fee.

(e) Warranty Information (eBike)

  • Each new Moto E Bikes e-bike comes with a limited manufacturer’s warranty for the original retail purchaser.

  • Warranty claims are for manufacturer’s defects within the 1-year guarantee period.

  • Damaged products upon delivery must be reported within 3 working days.

  • Moto E Bikes reserves the right to determine warranty coverage based on product use and user error.

  • Component replacements are subject to warranty conditions.

  • Moto E Bikes reserves the right to use substitute parts as part of warranty claims.

This warranty is effective under specified conditions, including purchase directly from Moto E Bikes' website or authorized retailers, adherence to intended use purposes, no repair or modification to electronics, assembly by knowledgeable bike mechanic or professional, and compliance with rider and weight limitations.

Battery Safety and Charging

Moto E Bike e-bikes come with rechargeable batteries that must be charged using a regular wall outlet. No other type of outlet, such as an RV outlet, inverter, converter, or charger not recommended by Moto E Bike, should be used.

 

Purchaser assumes all risks and responsibilities associated with charging the battery, including using only the recommended charging methods and following instructions provided by Moto E Bike.

 

Failure to comply with battery charging instructions and recommendations could result in catastrophic consequences, including battery malfunction, sparking, explosion, or a battery fire.

 

Moto E Bike is not responsible or liable for any damage caused by battery misuse, improper charging, or failure to adhere to recommended charging practices.

Changes to Terms

We reserve the right to modify or update these Terms and Conditions at any time without prior notice. Your continued use of our website after changes indicates your acceptance of the modified terms.
